THE LAW ON PROTECTION OF THESLOVENE MINORITY INITALY

The author deals with the law on the protection of the Slovene minority in Italy, passed by the parliament in Rome in February 2001. The first part of the article brings a short historic survey of preparations of the law as well as the then political situation. The second part, however, brings a detailed analysis of the law itself as compared to the framework law on the protection of the linguistic minorities in Italy, giving positive and negative aspects aris- ing from this comparison. Then comes the analysis of some aspects of the law, especially those relating to its implementation, beginning with the competences of the Parity Committee which is the key element in the entire procedure of implementation. Finally, the author includes a short comparison of the law with international obligations adopted by Italy.

Avtor v članku obravnava zakon za zaščito slovenske manjšine v Italiji, ki ga je rimski par- lament odobril februarja 2001. Prvi del članka vsebuje kratek zgodovinski pregled priprav na izdelavo zakona in politični okvir tistega časa. V nadaljevanju avtor podrobno obrav- nava vsebino zakona v primerjavi z okvirnim zakonom za zaščito jezikovnih manjšin v Italiji ter navaja pozitivne in negativne aspekte, ki iz te primerjave izhajajo. Sledi analiz nekaterih aspektov zakona, zlasti tistih, ki se nanašajo na njegovo izvajanje, začenši s pris- tojnostmi paritetnega odbora, ki je ključni element pri celotnem postopku izvajanja. Ob koncu avtor še vključuje kratko primerjavo zakona z mednarodnimi obveznostmi, ki jih je sprejela Italija.
